Terms and conditions governing the use of the ProBono.id platform. By using our services, you agree to the following terms.

1. Acceptance of Terms

By accessing or using ProBono.id ("Platform", "we", or "our services"), you ("User" or "you") agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations of the Republic of Indonesia.

If you do not agree with these terms, please do not use this Platform.

2. About ProBono.id

ProBono.id is Indonesia's first multi-disciplinary pro bono platform connecting underserved communities with volunteer professionals in the fields of law, health, and mental health.

Our services:

  • 100% free for help seekers (no consultation fees or hidden charges)
  • Connecting help seekers with verified professional volunteers
  • Providing consultations via Google Meet (online)
  • Facilitating pro bono events organized by organizations

3. User Eligibility

To use this Platform, you must:

  • Be at least 18 years old or have parental/guardian consent
  • Have legal capacity to enter into binding contracts under Indonesian law
  • Provide accurate and complete registration information
  • Maintain the security of your account (password and credentials)
  • Not have been previously banned from using our services

4. User Account Types

4.1 Help Seeker

Individuals seeking free consultations from volunteer professionals.

Your Rights:

  • Search and view verified volunteer profiles
  • Submit consultation requests
  • Receive free consultations subject to volunteer availability
  • Provide ratings and reviews after consultations are completed

Your Responsibilities:

  • Provide accurate and honest case information
  • Respect volunteers' time and expertise
  • Attend scheduled consultations or cancel with reasonable notice
  • Do not use the Platform for emergencies (see Section 6)

4.2 Volunteer

Licensed professionals who provide pro bono services voluntarily.

Requirements:

  • Lawyer: Active PERADI membership + passed advocate examination
  • Doctor: STR (Registration Certificate) + SIP/SIK (Practice/Work Permit)
  • Psychologist: SIPP (Psychologist Practice Permit) + HIMPSI membership
  • Counselor: Certification + institutional affiliation

Your Rights:

  • Accept or decline consultation requests
  • Set your own availability and schedule
  • Receive automatic pro bono hour tracking
  • Build reputation through ratings and reviews

Your Responsibilities:

  • Maintain valid professional licenses and credentials
  • Comply with your profession's code of ethics
  • Provide services with the same professional standards as paid practice
  • Maintain confidentiality of client information
  • Respond to consultation requests within 48 hours
  • Propose time slots within 24 hours after accepting a case

4.3 Organization

Legal firms, health clinics, or social service organizations that organize pro bono events.

5. Volunteer Verification

All volunteers must undergo administrative verification before accepting consultations:

  • Upload credential documents (licenses, certificates, professional organization memberships)
  • Verification by ProBono.id admin team
  • Only verified volunteers appear in public search results

Important: Our verification is administrative (document checking). ProBono.id does NOT conduct criminal background checks or other in-depth investigations.

6. Non-Emergency Services

Our platform is equipped with automatic emergency detection that will block consultation requests and direct you to emergency services if emergency keywords are detected.

7. Platform Limitations and Disclaimers

7.1 Not a Formal Professional Relationship

Consultations through ProBono.id:

  • Do NOT establish an attorney-client relationship (for legal consultations)
  • Do NOT establish a doctor-patient relationship (for health consultations)
  • Do NOT establish a therapist-patient relationship (for mental health consultations)

Consultations are informational and educational. For formal legal representation, medical diagnosis, or clinical treatment, please contact professionals directly outside the platform.

7.2 Volunteers Act Independently

Volunteers on ProBono.id are independent professionals, not employees or agents of the Platform. ProBono.id:

  • Does not supervise or control how volunteers provide consultations
  • Is not responsible for volunteers' advice, diagnoses, or actions
  • Does not guarantee consultation results
  • Only provides a technology platform to facilitate connections

7.3 No Guarantees

ProBono.id does NOT guarantee:

  • Volunteer availability for every consultation request
  • Specific response times (although we encourage a 48-hour standard)
  • Quality or accuracy of advice provided by volunteers
  • Specific legal, medical, or mental health outcomes
  • 100% Platform uptime (services may be interrupted for maintenance)

8. Data Collection and Use

ProBono.id collects and processes personal data in accordance with Law No. 27 of 2022 on Personal Data Protection and our Privacy Policy.

Data we collect:

  • Account information: Name, email, password (hashed), phone number
  • Case information: Case description, legal area, language preference
  • Volunteer credentials: Licenses, certificates, professional affiliations
  • Consultation data: Consultation notes, hours logged, ratings
  • Anonymous sessions: Emergency keyword detection (without user ID)

9. Prohibited Uses

You MAY NOT use the Platform for:

  • Emergencies: Medical, legal, or psychological conditions requiring immediate response
  • Fraud: Providing false information, claiming invalid credentials
  • Harassment: Harassing, threatening, or abusing volunteers/other users
  • Discrimination: Discriminatory content based on race, religion, gender, sexual orientation, disability
  • Spam: Sending repeated unnecessary requests or promotional content
  • Legal violations: Illegal activities or violations of Indonesian law

10. Intellectual Property Rights

All content on the Platform (text, graphics, logos, code) is owned by ProBono.id or our licensors and is protected by Indonesian and international copyright law.

You MAY NOT:

  • Copy, modify, or distribute Platform content without permission
  • Use ProBono.id logos or trademarks without written permission
  • Scrape or automatically extract data from the Platform

11. Account Suspension and Termination

ProBono.id reserves the right to suspend or terminate your account at any time if:

  • You violate these Terms of Service
  • You engage in prohibited uses (Section 9)
  • Volunteer credentials are no longer valid or have expired
  • We receive reports of harassment or ethical violations
  • We are required by law or court order

Process:

  • Warning: For first-time violations (except serious violations)
  • Temporary suspension: 7-30 days for repeated violations
  • Permanent termination: For serious or repeated violations

12. Limitation of Liability

To the extent permitted by Indonesian law, ProBono.id and its directors, employees, volunteers, and partners are NOT liable for:

  • Indirect damages: Loss of profits, data, reputation, or consequential damages
  • Volunteer advice: Accuracy, completeness, or results of consultations
  • Technical issues: Downtime, bugs, third-party service disruptions (Google Meet, hosting)
  • Third-party violations: Actions of volunteers or other users

Our maximum liability is limited to the amount you have paid us in the last 12 months (Rp0 for help seekers).

13. Indemnification

You agree to indemnify and hold harmless ProBono.id from all claims, damages, and costs (including attorney fees) arising from:

  • Your violation of these Terms of Service
  • Violation of laws or third-party rights
  • Unauthorized or abusive use of the Platform

14. Dispute Resolution

Governing Law: These Terms of Service are governed by the laws of the Republic of Indonesia.

Jurisdiction: Any disputes shall be resolved through the competent courts in Jakarta, Indonesia.

Mediation: Before filing a lawsuit, the parties agree to attempt to resolve disputes through good faith mediation.

15. Changes to Terms of Service

ProBono.id reserves the right to modify these Terms of Service at any time. Changes will:

  • Be published on this page with the "Last updated" date
  • Be notified via email to registered users (for material changes)
  • Become effective 30 days after notification

Continued use of the Platform after changes take effect indicates your acceptance of the new terms.

16. Severability

If any provision of these Terms of Service is declared invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and ProBono.id regarding use of the Platform.
